MOTORCYCLE RENTAL TERMS & AGREEMENT

These Rental Terms & Agreement form part of the rental agreement between Clutchy Ride (“Clutchy Ride”, “we”, “us”) and the customer (“Renter”, “you”).

By making a reservation, signing the rental agreement, or taking possession of a motorcycle from Clutchy Ride, you confirm that you have read, understood, and agreed to these terms.

1. RESERVATION & PAYMENT

A reservation is confirmed once Clutchy Ride has received the required booking payment or deposit.

The remaining balance must be paid according to the payment arrangement confirmed at the time of booking.

All prices are based on the motorcycle, rental period, and additional equipment agreed at the time of booking.

Additional services or equipment, such as top boxes, panniers, luggage, or other accessories, may be charged separately.

2. RENTAL PERIOD

A rental day is calculated as a 24-hour period, starting from the agreed pick-up time.

For example, if the motorcycle is collected at 10:00 AM, it should normally be returned by 10:00 AM on the agreed return date.

Hourly or partial-day rates are not automatically available unless agreed in advance.

If the motorcycle is returned late, additional charges may apply.

If you return the motorcycle earlier than the agreed rental period, the unused rental days are not automatically refundable.

3. MOTORCYCLE AVAILABILITY

Clutchy Ride will make reasonable efforts to provide the motorcycle model confirmed in the reservation.

In exceptional circumstances, including mechanical problems, accidents, theft, or other events outside our reasonable control, the confirmed motorcycle may become unavailable.

In such cases, Clutchy Ride may offer:

  • The same model, if another motorcycle is available;
  • A similar or upgraded motorcycle, subject to availability; or
  • An appropriate adjustment or refund if the replacement motorcycle is of a lower rental value.

4. CANCELLATION

Cancellation conditions depend on the booking arrangement confirmed with the customer.

Unless otherwise agreed in writing, the following policy applies:

  • More than 30 days before the rental: full refund of the booking deposit.
  • 30–15 days before the rental: 30% of the total rental price may be retained.
  • 14–8 days before the rental: 50% of the total rental price may be retained.
  • 7–1 days before the rental: 80% of the total rental price may be retained.
  • No-show: 100% of the total rental price may be charged.

If the amount already paid is greater than the applicable cancellation charge, the remaining amount will be refunded according to the original payment method, unless otherwise agreed.

Different cancellation conditions may apply to special offers, long-term rentals, group bookings, or third-party bookings.

5. RESCHEDULING

A customer may request to change the rental dates.

Requests should be made as early as possible and are subject to motorcycle availability.

Clutchy Ride may charge an administrative or rescheduling fee depending on the booking and the number of days before the original rental date.

A change of rental dates is not confirmed until Clutchy Ride confirms the new dates in writing.

6. RENTER REQUIREMENTS

The renter is responsible for ensuring that they are legally permitted to operate the motorcycle in Vietnam.

The renter must have:

  • A valid passport or other accepted identification;
  • A valid motorcycle driving licence appropriate for the motorcycle being rented; and
  • An International Driving Permit (IDP) or other documentation required for legally riding in Vietnam, where applicable.

Vietnam’s current road traffic framework has been in force since 1 January 2025, and foreign riders should ensure that their licence and accompanying documents meet the requirements applicable to them.

Clutchy Ride may refuse to release a motorcycle if the renter cannot provide the required documents.

Any consequences resulting from riding without the legally required licence or documents remain the responsibility of the renter.

7. CONDITION OF THE MOTORCYCLE

Before the rental begins, Clutchy Ride and the renter should inspect the motorcycle.

Existing damage should be recorded through photographs, videos, or a damage checklist.

The renter agrees to return the motorcycle in substantially the same condition in which it was received, allowing for normal wear and tear.

The renter must not remove, replace, modify, or tamper with any motorcycle components without prior permission from Clutchy Ride.

8. RENTER’S RESPONSIBILITIES

During the rental period, the renter must:

  • Ride carefully and responsibly.
  • Follow Vietnamese traffic laws.
  • Wear a properly fastened helmet.
  • Use the motorcycle only for lawful purposes.
  • Take reasonable care of the motorcycle.
  • Secure the motorcycle when parked.
  • Contact Clutchy Ride promptly if a problem, warning light, accident, or damage occurs.
  • Stop riding if continuing to ride could create a safety risk or cause further mechanical damage.

The renter is responsible for checking basic operating conditions during the rental, including tyre condition, tyre pressure, engine oil, coolant where applicable, and other obvious issues.

9. PROHIBITED USE

Unless specifically agreed in writing, the renter must not:

  • Allow an unauthorised person to ride the motorcycle.
  • Allow a person without the appropriate driving licence to ride the motorcycle.
  • Ride under the influence of alcohol, drugs, or other substances that impair riding ability.
  • Use the motorcycle for racing or competition.
  • Participate in motorcycle events, races, or timed challenges.
  • Perform stunts, burnouts, wheelies, or other dangerous riding.
  • Use the motorcycle for commercial purposes or passenger transportation for payment.
  • Make technical modifications to the motorcycle.
  • Change the motorcycle’s appearance, paint, stickers, or bodywork.
  • Remove or alter the registration plate or other identification.
  • Use the motorcycle for illegal activities.
  • Take the motorcycle outside Vietnam without prior written permission from Clutchy Ride.

Off-road riding or riding on unsuitable roads is permitted only where specifically agreed with Clutchy Ride.

10. MOUNTAIN & REMOTE-ROAD RIDING

Customers renting motorcycles in areas such as Hà Giang should understand that mountain roads can include:

  • Steep climbs and descents;
  • Sharp corners;
  • Gravel or damaged road surfaces;
  • Wet or slippery roads;
  • Fog and reduced visibility;
  • Animals, pedestrians, and unexpected vehicles;
  • Limited mobile phone coverage;
  • Long distances between repair facilities.

The renter is responsible for adjusting their speed and riding style to the road and weather conditions.

Clutchy Ride strongly recommends conservative riding, especially on unfamiliar mountain roads.

11. DAMAGE & LIABILITY

The renter is responsible for damage to the motorcycle or rental equipment caused by their negligence, misuse, accident, improper operation, or violation of these terms.

This may include damage to:

  • Engine and mechanical components;
  • Bodywork and fairings;
  • Wheels and rims;
  • Tyres;
  • Lights and indicators;
  • Mirrors;
  • Exhaust system;
  • Luggage racks;
  • Top boxes and panniers;
  • Keys;
  • Helmets and other rental equipment.

Normal wear and tear resulting from reasonable use is not considered renter-caused damage.

The amount charged will be based on the reasonable actual cost of repair or replacement.

12. TYRE & PUNCTURE DAMAGE

Punctures and tyre damage during the rental period are generally the renter’s responsibility when caused by road hazards, improper riding, or continued riding after a tyre has lost pressure.

If the damage results from a manufacturing defect or a mechanical issue unrelated to the renter’s use, Clutchy Ride will assess the situation accordingly.

The renter must contact Clutchy Ride before arranging major repairs whenever reasonably possible.

13. BREAKDOWN & MECHANICAL FAILURE

If the motorcycle develops a mechanical problem that is not caused by the renter’s misuse or negligence, Clutchy Ride will make reasonable efforts to provide assistance.

Depending on the situation, Clutchy Ride may:

  • Arrange roadside assistance;
  • Arrange a local repair;
  • Provide a replacement motorcycle where reasonably possible; or
  • Discuss an appropriate solution based on the circumstances.

The availability and response time of assistance may be affected by remote locations, weather, road conditions, and mobile phone coverage.

If a mechanical problem is caused by misuse, an accident, improper operation, or negligence, the renter may be responsible for the resulting costs.

14. ACCIDENTS

In the event of an accident, the renter must:

  1. Stop safely and check for injuries.
  2. Contact emergency services when necessary.
  3. Contact Clutchy Ride as soon as possible.
  4. Contact the local authorities where required.
  5. Take photographs and videos of the accident scene and motorcycle damage when safe.
  6. Collect relevant information from other parties involved.
  7. Cooperate with the authorities and any investigation.

The renter must not leave the scene of a serious accident without taking appropriate action.

The renter must not agree to major compensation, repairs, or settlements on behalf of Clutchy Ride without contacting us first, unless immediate action is necessary for safety.

15. INSURANCE

Any insurance coverage applicable to the motorcycle will be based on the actual insurance policy associated with the motorcycle and the terms communicated by Clutchy Ride.

The renter should not assume that personal injury, motorcycle damage, theft, luggage, medical expenses, or travel interruption are automatically covered.

Clutchy Ride strongly recommends that international customers obtain suitable travel, medical, accident, and personal liability insurance before riding in Vietnam.

Insurance coverage may be invalid or limited if the renter:

  • Rides without the legally required licence;
  • Rides under the influence of alcohol or drugs;
  • Uses the motorcycle for prohibited activities;
  • Uses the motorcycle outside an agreed area;
  • Leaves the scene of an accident;
  • Provides false information; or
  • Violates the terms of the rental agreement.

16. TRAFFIC FINES & LEGAL COSTS

The renter is responsible for all traffic fines, penalties, tolls, parking charges, impound fees, and other costs resulting from their use of the motorcycle during the rental period.

This includes violations involving speeding, parking, traffic lights, restricted roads, riding without the required documents, or other traffic offences.

If Clutchy Ride incurs an administrative or processing cost in connection with a renter’s violation, the renter may also be responsible for that reasonable cost.

Vietnam’s current traffic rules and administrative penalties are governed by the applicable legislation in force during the rental period.

17. FUEL

Unless otherwise agreed, the motorcycle is provided with an agreed fuel level and should be returned with approximately the same level.

If the motorcycle is returned with significantly less fuel, Clutchy Ride may charge the cost of the missing fuel and a reasonable refuelling service fee.

18. RENTAL EQUIPMENT

All equipment supplied by Clutchy Ride remains the responsibility of the renter during the rental period.

This may include:

  • Helmets;
  • Top boxes;
  • Panniers;
  • Phone holders;
  • Rain gear;
  • Locks;
  • Luggage;
  • Other accessories.

Lost or damaged equipment may be charged at the reasonable replacement or repair cost.

19. SECURITY DEPOSIT

Clutchy Ride may require a security deposit depending on the motorcycle, rental period, and booking.

The deposit is held as security against:

  • Motorcycle damage;
  • Loss of equipment;
  • Lost keys;
  • Unpaid rental charges;
  • Traffic fines or other charges attributable to the renter.

The deposit will be returned after the motorcycle has been inspected and all outstanding charges have been settled.

Where damage or other costs are still being assessed, Clutchy Ride may temporarily retain the relevant amount until the assessment is completed.

20. THEFT OR LOSS OF THE MOTORCYCLE

The renter must take reasonable precautions to protect the motorcycle.

The motorcycle must be locked when parked and should be parked in a reasonably safe location.

The renter must immediately notify Clutchy Ride and the local authorities if the motorcycle is stolen or cannot be located.

If the theft or loss results from the renter’s negligence, failure to secure the motorcycle, unauthorised use, or violation of this agreement, the renter may be responsible for the resulting loss.

21. RETURN OF THE MOTORCYCLE

The motorcycle must be returned:

  • At the agreed date and time;
  • At the agreed location;
  • With all keys and documents;
  • With all rented accessories;
  • In substantially the same condition as when collected, excluding normal wear and tear.

The renter must not leave the motorcycle at another location without prior approval from Clutchy Ride.

If the renter cannot return the motorcycle at the agreed time, they must contact Clutchy Ride as soon as possible.

A return delay of more than 30 minutes may result in an additional rental charge. Longer delays may be charged as an additional rental day.

22. EARLY RETURN

If the renter returns the motorcycle before the agreed end date, the original rental amount remains payable unless Clutchy Ride agrees otherwise.

Any refund for unused rental days is at the discretion of Clutchy Ride and depends on the circumstances and booking conditions.

23. FORCE MAJEURE

Clutchy Ride will not be responsible for failure or delay caused by circumstances beyond its reasonable control, including severe weather, natural disasters, road closures, government restrictions, strikes, accidents, civil emergencies, or other unforeseen events.

If such an event prevents the rental from starting or requires the rental to end early, Clutchy Ride will discuss reasonable options with the renter based on the circumstances.

24. PERSONAL BELONGINGS

Clutchy Ride is not responsible for the loss, theft, or damage of personal belongings left on or with the motorcycle.

The renter is responsible for keeping passports, money, electronics, luggage, and other personal items secure.

25. RIGHT TO TERMINATE THE RENTAL

Clutchy Ride may terminate the rental agreement and require the motorcycle to be returned immediately if the renter:

  • Seriously violates these terms;
  • Provides false or misleading information;
  • Rides without the required legal documents;
  • Uses the motorcycle in a dangerous or illegal manner;
  • Allows an unauthorised person to ride the motorcycle;
  • Fails to pay agreed rental charges; or
  • Uses the motorcycle in a way that creates a serious risk of damage or loss.

Any right of Clutchy Ride to claim reasonable damages or outstanding charges remains unaffected.
